Are Backgrounds Checks Necessary or an Infringement of Rights

A recent crime that can only be described as disturbing, that occurred at a Bonita Springs massage parlour has put a spotlight on safety whilst seeking relaxation.

A masseuse at Massage Luxe Spa, Marc DeTomaso has been accused of performing unwanted sexual acts on one of his female clients. This occurred on Super Bowl Sunday, although Marc DeTomaso was only arrested on the week of 10 May 2017. Deputies informed reporters that DeTomaso had: one hour into the Swedish massage proceeded to place his hands inside the client's underwear and perform an in appropriate sexual act on her.

We have received comments from other Southwest Florida massage therapists who have described these allegations as disturbing. This was mainly because, a therapist license is not easily obtainable in Florida. The Therapists license requires strict compliance with guideline and background checks, just like physical therapists and registered nurses.

Dating back to 2014, the state of Florida has required that all massage therapists undergo a background check and also fingerprinting through the FBI before they can receive their licence. This was an act by the Department of Health to try and weed out any licensed therapists who had criminal records.

Mindy Coward, an independent licenced massage therapist in Southwest Florida said that anyone who fails to comply with these guidelines and or does not meet the criteria for psychological adequacy should not be placed in such a profession as they will be in contact with people in vulnerable states.

The accused, DeTomaso had previously been arrested in Collier Country for drug possession in 2007, which was a charge that did not disqualify him from receiving his therapy licence.

Coward further said that it is vital to make an effort to read your reviews, go onto the internet and or ask around as there is various forms of accountability to be had online and though word of mouth.

The Department of Health spokesperson made a statement on how the department takes any accusation of sexual misconduct very seriously and if anyone has knowledge of any provider that is or has acted in an appropriate manner, they should report said person to the Department.
